Hello Everyone - a bit off topic from Mustaches and Kids -

A leading candidate has emerged for the next EFF Takedown Hall of Shame induction: the Dervaes Institute, which is claiming broad ownership rights over the term “urban homesteading” — a term commonly used to describe a social movement dedicated to achieving more self-sufficient, sustainable living in cities. Last year, the Institute managed to register the term as a trademark (in connection with “educational services” such as blogging) and it is now sending takedown requests and warning letters targeting individuals and organizations that have been using the term for years.

The Dervaes campaign raises two related issues.
First, as explained in more detail in a letter EFF sent today on behalf of three of the targets (Kelly Coyne and Erik Knutzen, authors of The Urban Homestead: Your Guide to Self-Sufficient Living in the Heart of the City, and their publisher, Process Media), the legal claims are baseless. Even assuming the registration is valid — there are reasons to question it — the term “urban homesteading” is commonly understood to refer to a popular movement and related set of practices. Our clients — and anyone else — are free to use it in that descriptive sense, and that is exactly what they did.

Second, this dispute highlights the increased danger of granting rights in descriptive marks such as this one. Time was, the registration of this kind of mark might have had limited impact, because sensible mark-owners would think twice before bringing legal action and, short of such action, most legal users could ignore any improper threats. In the Internet context, however, individuals and organizations rely on service providers to help them communicate with the world (YouTube, Facebook, eBay, Blogger, etc.). A trademark complaint directed to one of those providers can mean a fast and easy takedown given that those service providers usually don’t have the resources and/or the inclination to investigate trademark infringement claims. Moreover, because there is no counter-notice procedure, the targets of an improper takedown have no easy way to get their content back up.

So - in an effort to support the Urban Homesteading movement and the EFF I deliver you this post of protest.

12 - 23 was a good time as usual. Bruce represented UBB with some beautiful mustache pride. Phil and Brian as well. More photos of that to come from TC.

It was a great fund raising year - we doubled last years total and the early tallies put us at $3,646 dollars - which is a record for us!

Bavarian Hammer was won by mustache-less Dana Snyder - however the throwing star competition was dominated by the mustache wearing crew... There must be some correlation between a beautiful mustache and ninja stars accuracy.

We've been so busy growing that we've neglected the site, but it all changes right now.

We raised 1482 and counting... waiting on a final number from Urban Boat Builders. We are hoping to match our first year total of 2K. Apparently there are a few internet donations that need to be accounted for but all in all another solid year for MNM4K. We can all look back with a sense of accomplishment. It was also a year of transition with Peter's Currie and Delong and Greg took over the admin of MNM4K.

The RULES

For our donors and growers - I wanted to post the "Rules". Rules are really the guidelines we live by... and although these first three are no officially sanctioned by the mothership of mustaches WE at the MN local try to live by these first and the official rules second...

Think positive, even better, talk positive. According to scientists and psychiatrists, mustaches that grew up in a safe environment and received encouraging words grew to be twice as long and thick as those that were ignored or neglected.
Name your mustache. No one knows why, but engineers speculate that a mustache with a name feels more important and will in turn command more respect than one referred to as simply "mustache."
Regular exercise and a healthy diet. No I'm not suggesting that you lift weights or change what you eat. I am asking you to stretch and pull your mustache hairs, clean it, removing food particles and boogers, and maybe if you're feeling especially generous, take your 'stache for a walk.

BUT I digress - this post was about the "Official Rules" - so with no further delay here they are...

RULE 1. On the designated Clean Shaven Day (11/26/2008), participants (Growers) will shave their faces clean of any and all facial hair. This includes, but is not limited to, Mustaches, beards, goatees, muttonchops, chinstraps, soul patches, sideburns that extend below the top of the earlobe, and Van Dykes.
RULE 2. For the duration of one month (4 weeks) sweet Mustaches will be grown for the world to behold. During that time, there will be weekly Mustache Checkpoint Days. All involved will shave their mugs on Checkpoint Days, save for the area above their upper lips. No fair growing a full beard or goatee for a month, and then shaving down to just the Mustache.
RULE 3. The Mustache must only stretch from one corner of your mouth to the other corner. No Edwardian tapers. No Rollie Fingers handlebars. Just corner to corner conformity.
RULE 4. No Hitler Mustaches are allowed.
RULE 5. The use of growth hormones and coloring agents is not condoned or sanctioned by Mustaches for Kids. We feel that these Mustache Growing Performance Enhancers violate the spirit of the contest.
RULE 6. Though the Mustache Checkpoints are not mandatory - Mustaches for Kids believes in the Honor System - they are a great opportunity to encourage your Mustache brothers-in-arms during the growing season. Mustaches for Kids representatives will be available at all Checkpoints to address any Mustache questions or concerns. And we will drink beer.
RULE 7. With such burgeoning Mustaches firmly in place, fundraising should be a walk in the park. The minimum Pledge Goal for each Grower should be $50.00 for the designated charity, but in no way should anyone be discouraged from participating in the contest because he doesn't think he can make the Pledge Goal - $5 or $500, it goes to a good cause. Please be aware of and obey all local laws when soliciting donations.
RULE 8. While Mustaches for Kids does not endorse trash-talking or making disparaging comments of any kind about another Grower's Mustache, there are a number of unsubstantiated medical theories that Mustache Abuse stimulates follicle growth.
RULE 9. When all is said and done, a Mustache Competition will be held, at which a panel of judges will select the Sweetest 'Stache, using a complicated, and very scientific, set of criteria; Mustaches will be judged solely on these standards. Race, creed, nationality, sexual orientation, and popularity will not be taken into consideration. As in past years, booing will not be tolerated, especially by rival competitors; this is for charity, after all. Much like the Mustache Checkpoints, the final judging should foster a party-like atmosphere to celebrate the fruits of everyone's Mustache labors.
RULE 10. While the Growing Season will end after four weeks, there is no deadline for fundraising. Checks should be made payable to the designated charity with "Mustaches for Kids" written in the Memo portion. Donations, by check, to 501 (c)(3) nonprofit organization are are tax-deductible. You can hand off checks to a Mustache Representative at the Mustache Checkpoints, at the Mustache Contest, or contact your local chapter organizer for a mailing address.
RULE 11. Finally, while merchandising is encouraged, please do not violate any local, state, or national statutes. For example, sales tax regulations may apply. And all profits must be donated as well.
RULE 12. Good luck and good growing

People's Choice Awards One 'Stache = One Vote

At the end of the growing season we held a 'Stache Bash to total the money raised for Urban Boat Builders as well as voted on a number of mustache categories (7 categories in all). The system is simple, "One mustache" = "One Vote"... only four out of the seven categories had distinct winners and the winners for those are as follows:

Dirtiest Mustache Award - aka the Nast-dee-est 'Stach award went to Peter Delong...which after this year will be know as the Peter Delong Dirtiest Mustache Award

The Sissy Mustache Award - went unanimously to Marty Ruddy, due to the fact that he 1) shaved early, and 2) left the 'stache bash first... in Marty's defense, he did have a strong fund raising effort

Welcome to the Twin Cites Mustaches for Kids

We are greatful to be a part of the M4K community and we had an amazing first growing season. A small, dedicated group 6.5 local growers participated in the inagural season with 2 out of state guys growing with us as well. We were able to raise $1,222 dollars for Urban Boat Builders (www.urbanboatbuilders.org) and are excited for next year. We will be expanding our group of growers next year, so if you are willing to grow a stache, raise some money for kids, enjoy a good time and live in the twin cities - we would welcome you with open arms.

There is one thing I would like to clear up for those of you not familiar with Mustaches For Kids - this is not "Locks of Love" for kids that can't grow mustaches.
